Settlement with three major retailers for compliance with Raincheck law announced

Consumer Protection Commissioner Jerry Farrell, Jr. announced today that his agency has entered into agreements with three major retailers to resolve investigations about their compliance with raincheck laws. The stores are Staples - the Office Superstore East Inc., Circuit City Stores Inc. and Home Depot U.S.A. Inc. This past spring, the Department of Consumer Protection investigated the advertising and business practices of several retailers doing business in Connecticut. As a result, each retailer entered into an agreement with the Department that it would comply with the Raincheck law in the future and pay the Department $1,000.

The Connecticut Raincheck law says that when a retailer advertises an item at a “sale” price, it is required to maintain enough stock to meet reasonably anticipated demand. If the item is not available for purchase for the duration of the advertised sale period, the retailer is required to offer the consumer a “raincheck” with certain exceptions.

“I want to remind consumers that stores advertising items on sale should have sufficient inventory or provide a raincheck to customers when the product is not available. We often hear from consumers who went to stores on the first day of a sale only to find that the item is ‘sold out’. Please call the Department of Consumer Protection at 800-842-2649 if you have any questions about rainchecks or any other advertising questions” said Commissioner Farrell.
